General Rules

Production must begin principal photography within 90 days of application. Any changes to start date must be submitted for approval to the attention of the Columbus Film Commission Program Director and Accounting Firm immediately or certification will be revoked.

Applications submitted MORE THAN 90 DAYS prior to start of principal photography WILL NOT BE CERTIFIED.

Production must meet with the Commission and spend a minimum two days of scouting before applying.

Productions must have spoken with Peter Bowden, Program Director or a qualified person within the Commission.

An applicant can qualify only once per year unless a negotiated (2) two or more packaged film deal is agreed to in advance or the budgets collectively exceed $15 million. An applicant is defined as the company actually entitled to receive the grant with any common ownership, corporate officers or other verifiable affiliation. Work-for-hire companies are not eligible for the grant.

Proof of final project budget and funding must be submitted along with this application in order for the application to be considered complete. Final project budget shall be defined as: (a) the amount that is approved by the relevant completion bond company; or (b) the budget that is demonstrably approved and funded by the financiers.

I understand and agree that the goal of the Columbus Film Fund Production Incentive Program is to provide an additional benefit to productions and also to promote local economic growth by ensuring that local service providers are hired and paid. Thus, I understand and agree that I have the obligation and intent to pay all local service providers in full.

I understand and agree that Columbus Film Fund and the Columbus Economic Development Corporation, and the Columbus Film Commission maintain the right and ability to accept or refuse any application in their sole discretion.

I understand and agree that I have read this entire application in its entirety, including any and all exhibits, and I understand and agree to abide by all terms.

I represent and warrant that I have full permission and authority to sign as an authorized representative of Applicant and to bind Applicant to the terms of this application.

I understand and agree that the end credit roll of any production that utilizes the Columbus Film Fund’s Production Incentive Program grants must recognize Columbus Film Fund and Columbus Film Commission and is required to use the Columbus Film Commission logo in end credits. The Columbus Film Fund and Columbus Film Commission reserve the right to refuse use of its logo in the credits of any production filmed or produced in Muscogee County. Producer acknowledges and confirms that Producer is in receipt of the Columbus Film Commission logo. Size and placement of the logo is at the Producer’s discretion.

I understand that to qualify for a Columbus Film Fund grant, a project must have a minimum qualified spend of $500,000 in Muscogee County & 60% of shooting days must be in Muscogee County (unless budget exceeds $15 million, in which case 50% of shooting days must be in Muscogee County).

Certification by Applicant

Applicant is responsible for accuracy of all data and documentation included in this application. Initial applications are submitted to the Columbus Film Fund’s attorney. Once submitted, applications will become the property of the Columbus Film Fund. It is the applicant’s responsibility to inform the Columbus Film Fund in the event that there are changes to any information on the application. Amendments must be sent via email to Barnes & Thornburg.

Upon written request, applicants shall issue any necessary authorization to the appropriate federal, state or local authority for the release of information concerning a production being considered under these administrative rules, including but not limited to financial reports and records relating to the applicant or to the production for which this grant is requested.

By signing below, the applicant certifies that all the information contained herein and exhibits attached hereto are true to the best of their knowledge and are submitted for the purpose of obtaining a Columbus Film Fund grant through the Columbus Film Commission.

Additional Terms and Conditions

  1. Governing Law. Applicant agrees that the exclusive jurisdiction and venue for any legal action relating to this application in any way will be the State or Superior Court of Muscogee County, Georgia and that the terms of this application shall be construed and enforced in accordance with the laws of the State of Georgia. Applicant further agrees that if Columbus Film Fund is forced to file a lawsuit against Applicant due to the provision of false information or any other reason and prevails in court, Applicant will be responsible for all of Columbus Film Fund’s attorney’s fees and associated costs and expenses.
  2. Opportunity to Consult Counsel. In submitting this application, Applicant acknowledges and warrants that Applicant has had the opportunity to consult with, and seek the advice of, independent counsel with respect to the terms and conditions of this application and Applicant’s execution hereof. Applicant further acknowledges and represents that Applicant has executed this application freely and without duress after having an opportunity to read this application in its entirety, including the attached exhibits.
  3. Representations, Warranties and Covenants. Applicant hereby acknowledges and warrants that the Columbus Film Fund and the Columbus Film Commission have made no guarantees or promises of payment unless Applicant fully adheres to the terms of this application and Columbus Film Fund Production Incentive Program Guidelines, including but not limited to the provision of full and adequate proof of the minimum expenditure in Muscogee County.
  4. Successors and Assigns. Applicant shall have no right to assign any of their rights or obligations under this application without the written consent and permission of Columbus Film Fund and the Columbus Film Commission. Neither this application nor any documents executed in connection herewith shall inure to the benefit of any third person or entity.
  5. Sole Agreement. The agreement between Applicant, Columbus Film Fund and the Columbus Film Commission consists only of the express written terms and conditions set forth in this application, including any other written agreement entered into in connection herewith. Except as set forth hereinabove, all understandings and agreements heretofore made between the parties are merged into this application and the documents contemporaneously executed in connection herewith, which alone fully and completely express the parties’ understanding. There are no promises or agreements, oral or otherwise, inducing submittal of this application, except only as expressly set forth in writing herein or in the documents contemporaneously executed in connection herewith. The parties are relying only on the express terms, conditions and agreements set forth herein and in the documents contemporaneously executed in connection herewith. The parties further agree that any promise or agreement not expressly set forth in writing and signed by the parties cannot be relied upon and will not be valid or enforceable.


EXHIBIT “A”

Columbus Film Fund Entertainment Production Incentives Guidelines

Production Requirements for Feature Films, Made for TV Movies & TV Pilots

  • Applicant’s project must have a budget of $1 million.
  • The Columbus Film Fund will assess each applicant’s project on its merits and for its commercial viability with promise of meaningful return on investment.
  • Preference will be given to projects that are written, directed, produced, financed, or in other ways created or controlled by Georgians given equal commercial viability.
  • Selected projects must have a minimum qualified spend of $500,000 in Muscogee County & 60% of shooting days must be in Muscogee County (unless budget exceeds $15 million, in which case 50% of shooting days must be in Muscogee County).
  • Pre-production operations must be headquartered in Muscogee County.
  • An applicant must agree to exclusively hire and train Georgia Film Academy interns from Columbus State University.
  •  An applicant can qualify only once per 12 month period unless a negotiated (2) two or more packaged film deal is agreed to in advance or the budgets collectively exceed $15 million. An applicant will be considered the same for incentive program purposes if the applicant shares any common ownership, corporate officers, or other verifiable affiliation with a previous applicant.
  • An applicant must meet with the Columbus Film Commission (Commission) and spend a minimum of two days of scouting before applying.
  • The Columbus Film Fund will negotiate an equity position in each project receiving a Columbus Film Fund incentive grant.
  • An applicant must provide all necessary documentation for audit of application (including exhibits) within 120 days of the completion of principal photography. If post-production takes place in Muscogee County, this deadline shall be extended until 120 days from the completion of the Muscogee County post-production.
  • The Columbus Film Commission logo must be displayed in end credits.

Production Requirements for Television or Internet-Distributed Episodic Productions

  • Applicant’s project must have a minimum of (5) five episodes.
  • The Columbus Film Fund will assess each applicant’s project for its commercial viability with promise of meaningful return on investment.
  • Preference will be given to projects that are written, directed, produced, financed, or in other ways created or controlled by Georgians given equal commercial viability.
  • Selected projects must have a minimum qualified spend of $400,000 per episode in Muscogee County
  • Selected projects must have 60% or more of shooting days in Muscogee County.
  • Pre-production operations must be headquartered in Muscogee County.
  • An applicant must agree to exclusively hire and train Georgia Film Academy interns from Columbus State University.
  • An applicant must meet with the Columbus Film Commission and spend a minimum of two days of scouting before applying.
  • The Columbus Film Fund will negotiate an equity position in each project receiving a Columbus Film Fund incentive grant.
  • An applicant must provide all necessary documentation for audit and completion of application (including exhibits) within 120 days of the completion of the end of principal photography.
  • The Columbus Film Commission logo must be displayed in end credits.

Incentive Packages May Include

  • Cash incentive grants may be applied for which have no specific minimum or maximum dollar amount except that no grant shall exceed 20% of the total value of the fund at the time of project pre-production.
  • The primary purpose of incentive grants is to provide funding to compensate producers for the additional per diem, housing and transportation costs associated with bringing crew to Columbus.
  • The Commission shall take bids from local hoteliers and apartment management companies to provide best available rates for housing crew and talent for each production.
  • The Commission will assist in identifying vendors, with whom the producer and/or director can negotiate best price discounts for production offices, other rentals, parking fees, catering, security/police, healthcare professionals, site rentals, fire and rescue service, filming permits and other production costs.
  • The Commission will provide information on renting an 180,000 sq. ft. soundstage and fully furnished production offices located in Columbus.
  • Columbus State University faculty will assist with casting calls and auditions.
  • Columbus State University will provide resumes for local workers who have completed the Georgia Film Academy on-set film production Nexus degree.
  • When possible, the Commission will secure in-kind support for projects in exchange for thank you recognition of said vendor in end credits.
  • Selected projects providing documentation that 85% of the production's budget was spent in Muscogee County may qualify for an additional 10% of an incentive grant.
  • The Commission will provide referrals to a Columbus based film distribution company for possible film distribution agreements.
  • Experienced film/television technicians with no fewer than (5) five years of verifiable experience, who relocate to Muscogee County with a minimum one-year lease or purchase of property and who reside the Muscogee County for a minimum of 30 days may apply for a $2,000 relocation reimbursement grant. Verifiable receipts or other documentary proof and possessing a valid Georgia driver’s license are required.
